Terms & Conditions
Contract
When a booking is made with Inter Tribes Safaris (ITS), either through an intermediary Agent or direct, a contract is entered between you and Inter Tribes Safaris (ITS) Tanzania Limited.
Reservations and Payment
When booking your holiday direct with Inter Tribes Safaris (ITS) or with your travel agent, please quote the tour number* or your own specialised itinerary, intended date for arrival and departure, number of people travelling in your party, sleeping arrangements and flight details, if known. This will ensure that our arrangements are to your satisfaction and concise.
On confirmation of your itinerary, please advise us of your full names as they appear in your passports, nationality, passport number and date of birth.
A 40% deposit is required at the time of booking confirmed with the balance to be settled 60 days prior to commencement of the tour. Inter Tribes Safaris will receipt your money, thereby confirming our safari. The deposit is due within 14 days of making the booking and there shall be no binding contract until the deposit has been paid. Failure to remit the deposit on time will result in automatic change of status from provisionally held/confirmed to provisional-only (possibly entailing subsequent wait-listing or even inability to reinstate the booking when the deposit is finally received).
Any booking made within 40 days of first providing services shall be accepted provided: space is available payment is received documents, if required, can be delivered prior to departure.

NOTE:
Gorilla trekking generally requires a minimum of 12 weeks advance booking. Children under twelve (12) years are not allowed to track chimpanzees and children under fifteen (15) years are not allowed to trek gorillas.
Mode of Payment
All prices are quoted in US Dollars. You may pay by wire transfer or cash to Inter Tribes Safaris (ITS), or your travel agent. Foreign currency cheques, travelers’ cheques and payment by credit card may be accepted subject to bank charges at the prevailing rate, based on local currency can be accepted at the current dollar buying rate. Cheques and travelers’ cheques may incur Manager’s Discretion service charge. The Company shall not be responsible for wire transfer charges.
Cancellation Charges and Refund
Any cancellation must be made to Inter Tribes Safaris (ITS) booking office in writing. A telephone call should be made to check that notice of cancellation has been received.

- 30% of Tour Price if cancelled 61 or more days prior to start day of the tour.
- 50% of Tour Price if cancelled 31 - 60 days prior to start day of the tour.
- 100% of Tour Price if cancelled 0 – 30 days prior to start day of the tour.
- Any bookings made through Inter Tribes Safaris Tanzania (or their agents) are liable to be charged 40% cancellation charges and additional penalty charges at the rate of 80% if cancelled 60 – 31 days prior to start day of the tour and 100% thereafter.
- Any bookings, which include private campsites (Shared or Private Camps), shall incur charges of US$60 per client per day.
- Gorilla permits are non-refundable.
- Any request to change or amend a booking once confirmed shall be accommodated if at all possible, subject to space availability.
- Should you fail to join a tour or join it after departure or leave it prior to its completion, no tour fare refund will be made. There will be no refunds from Inter tribes Safaris for any unused portions of the tour. The above policy applies to all travel arrangements made via Inter Tribes Safaris (ITS).
Transportation
Only safari-prepared 4 wheel drive vehicles are used on safari. The Company reserves the right to employ the services of sub-contractors. Highly trained and experienced driver/guides are provided. No vehicle may be driven by a client at any time.
Carriage (by land, sea and air) is subject to the terms and conditions of the carrier and to International Conventions, some of which limit liability. Land, sea and air travel are also subject to operational decisions of carriers and ports, which may result in cancellation, delays or diversions over which The Company has no control and for which Inter Tribes Safaris (ITS) can accept no liability whatsoever.

Accommodation
Accommodation is normally quoted based on two persons sharing a twin room or tent. Single occupancy may attract a supplemental single occupancy charge. Hotels, Lodge and camps are named as an indication of category and, whilst Inter Tribes Safari (ITS) shall endeavour to actually use the named establishment, rooms may be reserved at similar establishments without liability or refund. Published prices are based on tariffs and other costs prevailing at the time of printing and are subject to change without notice.

Client's Information
Inter Tribes Safaris (ITS) and its agents act as a booking agent in all matters relating to camp, hotel and lodge accommodation, tours, airlines/charters, bus companies, ground transportation, boat owners and other independent contractors providing accommodation, transportation and/or other services, each of which is an independent corporation outside Inter Tribes Safaris (ITS) control and each of which has it’s own terms and conditions. As such, Inter Tribes Safaris (ITS) shall not be liable for injury, delays, loss or damage in any manner.
Inter Tribes Safaris (ITS) liability to passengers carried in its own vehicles is governed by the laws of the country in which the tour takes place and no other country.
All claims are subject to the jurisdiction of the courts of the country in which the actual service or accommodation was provided.
Inter Tribes Safaris (ITS) reserves the right to employ sub-contractors for all or part of its services; in the event of such right the terms of this clause apply.
Whilst every care is taken, Inter Tribes Safaris (ITS) cannot be held responsible for loss or damage to baggage.
As provided for elsewhere in these terms and conditions, Inter Tribes Safaris (ITS) reserves the right to cancel any itinerary, holiday or service or any part of it, to make such alterations in the itinerary as deemed necessary or desirable, to refuse to accept or to retain as a member of any programme any person at any time and to pass on to programme members any expenditure occasioned by delays or events beyond Inter Tribes Safaris (ITS) control. In case of any appreciable variation in costs, right is reserved to adjust rates.
Inter Tribes Safaris (ITS) liability to passengers carried in its own vehicles is governed by the laws of the country in which the tour takes place and no other country.
All claims are subject to the jurisdiction of the courts of the country in which the actual service or accommodation was provided.

Yellow Fever and Cholera vaccinations are mandatory in many African countries. Other inoculations, such as Tetanus, Polio, Typhoid Meningitis and Hepatitis may also be recommended. Advice should be sought from a reputable travel clinic or medical practice in good time before departure, responsibility for so doing lies solely with the client.

Client’s attention is drawn to the fact that there are certain risks inherent in participating in the type of itinerary, holiday and service provided by Inter Tribes Safaris (ITS) (by dint, inter alia, of it’s location and the adventurous nature of some activities). Inter Tribes Safaris (ITS) shall not be liable for illness, injury or death sustained on an itinerary, holiday or service sold by it which is not due to gross negligence of Inter Tribes Safaris (ITS), its officers, employees, authorized representatives or agents whomsoever.

It is a condition of booking that the sole responsibility lies with the guest to ensure that they carry the correct comprehensive travel and medical insurance to cover themselves, as well as any dependents and traveling companions for the duration of their tour to East Africa. This insurance should include coverage in respect of, but not limited to, the following eventualities: cancellation or curtailment of the safari, emergency evacuation expenses, medical expenses, repatriation expenses, damage, theft or loss of personal baggage, money and goods.
Inter Tribes Safaris (ITS) will take no responsibility for any costs for losses incurred or suffered by the guest, or guest's dependents or traveling companions, with regards to, but not limited to, any of the above mentioned eventualities. Guests will be charged directly by the relevant service providers for any emergency services they may require, and may find themselves in a position unable to access such services should they not be carrying the relevant insurance coverage.
Inter Tribes Safaris (ITS) is able to arrange AMREF (Flying Doctor) cover (which it strongly recommends) on behalf of clients and will do so on some itineraries, adding the cost into the price of the holidays, unless instructed otherwise.
Inter Tribes Safaris (ITS) will take no responsibility for any costs for losses incurred or suffered by the guest, or guest's dependents or traveling companions, with regards to, but not limited to, any of the above mentioned eventualities. Guests will be charged directly by the relevant service providers for any emergency services they may require, and may find themselves in a position unable to access such services should they not be carrying the relevant insurance coverage.

Itinerary Amendment
Although every effort is made to adhere to itinerary, it should be noted that occasionally routes, lodges and camps may be changed while on safari as dictated by changing conditions. As example such conditions may be brought about by seasonal rainfall on bush tracks or “airfields” in game areas, by game migrations from one region to another, or airline or other booking problems. Inter Tribes Safaris (ITS) shall not be held responsible for such itinerary changes. We reserve the right to substitute camps, hotels and lodges and to alter the itinerary should this be considered necessary or advisable.
Force Majeure
"Force Majeure" means any circumstances where the execution of contractual services is prevented or affected by factors beyond the reasonable control of Inter Tribes Safaris (ITS) including, but not limited to acts of God, war and threat of war, civil strife, industrial dispute, terrorist activity, natural disasters such as weather conditions, earthquakes, volcano eruptions, fire, governmental actions and other unexpected occurrences.
In these circumstances, we shall not be liable to pay any compensation or otherwise be responsible for any expenses or losses the client may incur where we are forced as a result to cancel, delay, curtail or change the clients’ arrangements in any way or where the performance or prompt performance of our contractual obligations is prevented or affected.
Inter Tribes Safaris (ITS) also reserves the right to accept or decline any traveler on any trip, before or during the trip should such person's mental or physical condition impede the operation of the service or the rights, welfare or enjoyment of other travelers. In this case a refund of the unused land services is the limit of Inter Tribes Safaris (ITS) liability to the traveler removed.
We also reserve the right to alter or modify the itinerary of any tour or relocate accommodation if schedules, security matters and/or events beyond our control make such explained above.
In these circumstances, we shall not be liable to pay any compensation or otherwise be responsible for any expenses or losses the client may incur where we are forced as a result to cancel, delay, curtail or change the clients’ arrangements in any way or where the performance or prompt performance of our contractual obligations is prevented or affected.

Travel Documents
It is the client’s responsibility to ensure that all travel documents and vaccinations are current and valid for the journey in question.
Inter Tribes Safaris (ITS) shall not be responsible for any delay, interruption or cancellation resulting from client’s failure to provide required documentation to immigration or other authorities at any time.

Liability and Insurance
Although every possible care is taken to safeguard you and your property, Inter Tribes Safaris (ITS) acts only as an agent of the passenger in all matters relating to tours and accepts no responsibility for any personal illness, injury, accident, death, flights delay, any kind of loss, damage or irregularity of any kind, which may be occasioned by reason of any act or omission beyond its control, including without limitation, any act of negligence or breach of contract of any third party.
Photography
Inter Tribes Safaris (ITS) reserves the right to make use of any photography or film taken on your trip by our staff for promotional purposes without payment or permission. Where a client makes available to the Company photographs of their own, Inter Tribes Safaris (ITS) reserves the right to make use of such photos.
Complaints and Disputes
If there is cause for complaint whilst on holiday, whether with Inter Tribes Safaris (ITS) products or any other product for which Inter Tribes Safaris (ITS) has made booking as an agent, then this must be brought to the attention of the General Manager or his appointee or agent who will do their best to rectify the situation. It is unreasonable to take no action whilst on holiday and then write a letter of complaint upon return; Inter Tribes Safaris (ITS) cannot accept any liability in relation to any complaint or problem if such is not notified at the time of occurrence. Should the problem remain unresolved by Inter Tribes Safaris (ITS), third party contractor or product, a complaint should be made in writing to Inter Tribes Safaris (ITS) booking office within 28 days of completion of the itinerary, holiday or services provided by Inter Tribes Safaris (ITS).
Inside Parks and Reserves
Please be aware that our safaris may take you into close contact with wild animals. Attacks by wild animals are rare, but no safari into the African wilderness can guarantee that this will not occur. Inter Tribes Safaris (ITS) shall not be held responsible for any injury or incident on the safari. Please note that many safari lodges and camps are not fenced and that wildlife does move freely in and around these areas. Always follow the safety instructions from the lodge or camp staff with regards to moving to and from your tent and while on game activities throughout your safari.
Viewing Animals: When it comes to game viewing, please be advised there are no guarantees. It is a privilege to see animals in their natural habitat. Take only a photograph; leave only a footprint.
A gorilla permit guarantees you will trek gorillas to their location but does not guarantee that the gorillas be in plain sight.

Special Requests
Clients should advise Inter Tribes Safaris (ITS) of any special request (for example: special diet or on account of physical disability) at the time of enquiry or submitting a reservation. Inter Tribes Safaris (ITS) will do it’s utmost to meet such requests wherever possible.
Our Terms
These terms and conditions govern the relationship between the Company and it’s Agents/clients to the total exclusion of any other terms and conditions. No alteration to these terms and conditions may be made by any of Inter Tribes Safaris (ITS) employees, authorized representatives or agents unless in writing by one of Inter Tribes Safaris (ITS) authorized senior officers. All decisions subject to Inter Tribes Safaris (ITS) discretion shall be made by one of Inter Tribes Safaris (ITS) authorized senior officers.
Conditions of Booking
Whilst on holiday, clients are requested to comply with the instructions of Inter Tribes Safaris (ITS) representatives at all times.
Any client who shall be or become, in the opinion of any representative of Inter Tribes Safaris (ITS): incapable of caring for him/herself objectionable to others a hazard to him/herself or others shall not be permitted to continue on the itinerary, holiday or service provided by Inter Tribes Safaris (ITS) and, in such event, the booked arrangements might be terminated without any liability on either Inter Tribes Safaris (ITS) behalf or that of the supplier/contractor concerned.
Please remember that booking an itinerary, holiday or service with Inter Tribes Safaris (ITS) is entering into a binding agreement that assumes all the terms and conditions herein mentioned are fully understood.
The construction, validity and performance of any Agreement, including these terms and conditions, between the client and Inter Tribes Safaris (ITS) shall be governed by the Governments laws and the parties submit to the exclusive jurisdiction of the Country courts.
